This is even if you're using it with a google account that has billing connected.

The fine print is here: https://ai.google.dev/gemini-api/terms

If I'm being uncharitable this is purposefully deceptive / a dark pattern to scoop up as much data as possible.

Your link seems to say the opposite.

> Paid Services

>... When you activate a Cloud Billing account, all use of Gemini API and Google AI Studio is a "Paid Service" with respect to how Google Uses Your Data, even when using Services that are offered free of charge, such as Google AI Studio and unpaid quota of Gemini API.

>... How Google Uses Your Data When you use Paid Services, including, for example, the paid quota of the Gemini API, Google doesn't use your prompts (including associated system instructions, cached content, and files such as images, videos, or documents) or responses to improve our products, and will process your prompts and responses in accordance with the Data Processing Addendum for Products Where Google is a Data Processor. For Paid Services, Google logs prompts and responses for a limited period of time, solely for the purpose of detecting violations of the Prohibited Use Policy and any required legal or regulatory disclosures. This data may be stored transiently or cached in any country in which Google or its agents maintain facilities.

Activated a Cloud Billing account -> All use of Google AI Studio is a "Paid Service", even free use -> Google then doesn't use prompts or responses to improve the products

From their terms of service : When you use Paid Services, including, for example, the paid quota of the Gemini API, Google doesn't use your prompts (including associated system instructions, cached content, and files such as images, videos, or documents) or responses to improve our products, and will process your prompts and responses in accordance with the Data Processing Addendum for Products Where Google is a Data Processor. For Paid Services, Google logs prompts and responses for a limited period of time, solely for the purpose of detecting violations of the Prohibited Use Policy and any required legal or regulatory disclosures. This data may be stored transiently or cached in any country in which Google or its agents maintain facilities.

No? From the page you linked:

When you use Paid Services, including, for example, the paid quota of the Gemini API, Google doesn't use your prompts (including associated system instructions, cached content, and files such as images, videos, or documents) or responses to improve our products, and will process your prompts and responses in accordance with the Data Processing Addendum for Products Where Google is a Data Processor. This data may be stored transiently or cached in any country in which Google or its agents maintain facilities.

This is a complete misreading of these terms - they explicitly say the opposite.

Dark pattern now means to act in accord with your clearly written and prominently posted terms of service? Get a grip.

I find it a lot worse that Gemini on Google Workspace is allowed to use your data when you don't pay for it but not when you pay for it.

This is such a hard troublesome thing, i disabled the integration for it asap

So this is not the case for https://gemini.google.com ?

It is, everything you send to google will be used for training.

An AI trained on all Gmail user data, including business accounts and their attachments, would cause chaos of unprecedented levels.

Then again, with DOGE accessing classified government data and DOGE's links to xAI, we may have a chance to experience something like this.

(Shrug) Copyright is a bargain with the public domain, and so are LLMs.

It's a fair deal as long as the terms are disclosed, which they are. As usual, don't upload anything to the Internet today that you don't want to see in the New York Times tomorrow.

I assumed this was always the case.

I also assume any non local llm is storing data. Don't tell it anything you wouldn't tell a co worker or post publicly on Facebook.

Good: How do I download a file in Rust?

Bad: How do I minimize alimony payments in my divorce?

If you need security run Ollama locally. Regardless of what they claim "mistakes" happen.

> If you're in the European Economic Area, Switzerland, or the United Kingdom, the terms under "How Google uses Your Data" in "Paid Services" apply to all Services, including Google AI Studio and unpaid quota in the Gemini API, even though they are offered free of charge.

See, living in the EU is a perk!

So using AI based on other people's data is ok?

Honest question, why should it matter if Google trains on my data? These systems are already learning from so much data from other people, and if they use mine, it's just a tiny drop in the vast ocean of information they already have. It probably won't make of a difference overall.
